Terms of Service

These Terms of Service (the “Terms”) govern your use of the IQONIC application (the “App”), operated by IQON Health (“we”, “us”, or “our”). By downloading, accessing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

Eligibility

You must be at least eighteen (18) years old to use the App. By using the App you represent that you meet this requirement and that any information you provide is accurate and complete.

Accounts

Some features require an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Subscriptions and payments

Certain features are available only with IQON Premium, an auto-renewable subscription sold through the Apple App Store. The following terms apply:

• Title — IQON Premium.
• Length — offered as a monthly (1 month) or annual (1 year) subscription. The available durations are shown in the App before you purchase.
• Price — the price for each duration, in your local currency, is displayed in the App on the subscription screen and on the App Store product page before you confirm the purchase. Annual pricing is also shown so you can compare it against the monthly rate.
• Payment — payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal — the subscription renews automatically for the same duration at the same price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing and cancelling — you can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings. Once purchased, the current period is non-refundable and cancellation takes effect at the end of it.

Purchases are processed by Apple, not by us. Refunds are handled by Apple under its own policies; we cannot issue refunds for App Store transactions.

No medical advice

The App provides information and tools only. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical advice. Always consult a qualified healthcare provider with any questions about a medical condition, and never disregard professional advice because of something you have seen in the App.

Acceptable use

You agree not to:

• use the App for any unlawful purpose;
• interfere with or disrupt the App, its servers, or its security features;
• attempt to access accounts or data that do not belong to you; or
• use automated tools to scrape, crawl, or copy content from the App.

Intellectual property

The App, including its design, text, graphics, logos, and software, is owned by or licensed to IQON Health and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. No other rights are granted.

Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the App.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the App.

Termination

We may suspend or terminate your access to the App at any time for conduct that violates these Terms or is otherwise harmful. You may stop using the App and delete your account at any time.

Governing law

These Terms are governed by the laws of the United States and the state in which IQON Health operates, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
